Terms and Conditions of use and sale of the kyronedu.it website, pursuant to Legislative Decree 70/2003, Legislative Decree 206/2005 and articles 1326, 1341-1342 of the Italian Civil Code.

Site Owner and General Information
Kyron S.R.L. (hereinafter «Kyron» or the «Company»), with registered office at Via Cassia 515, 00189 Rome (RM), VAT no. 18520271000, PEC kyron@arubapec.it, e-mail info@kyronedu.it, is the operator of the website https://www.kyronedu.it (the «Site») and owner of the online sales activity carried out there.
These Terms and Conditions (the «T&C») govern access to and use of the Site, as well as the purchase of hardware products and technological devices through the e-commerce available there. The T&C apply to all users of the Site, regardless of their status: private consumers, professionals, companies and Public Administrations.
Accessing the Site and placing an order imply the full reading, understanding and acceptance of these T&C. Kyron reserves the right to amend the T&C at any time; changes take effect from the date of publication on the Site.
Scope and Users
The Site and the online sales services are accessible to:
- Consumers (natural persons acting for purposes outside their business or professional activity), to whom the protections of Legislative Decree 206/2005 (Consumer Code) apply;
- Professionals and economic operators (natural or legal persons acting in the exercise of their business or professional activity), to whom consumer-protection rules do not apply;
- Public Administrations (schools, public bodies and bodies governed by public law), to whom specific supply conditions may apply in compliance with public-procurement rules (Legislative Decree 36/2023 — Public Contracts Code).
For Public Administrations, in particular schools, the sales conditions may be supplemented or replaced by specific contractual agreements, purchase orders or conventions, which prevail over these general conditions in the event of conflict.
Registration and Reserved Area
To access certain Site features (order management, documents and purchase history) it is necessary to create a personal account by registering.
3.1 Registration requirements
The user must be at least 18 years old. When registering, the user must provide truthful, complete and up-to-date data. Kyron reserves the right to refuse or suspend registration in the event of incomplete or inaccurate data, or fraudulent use of the Site.
3.2 Access credentials
The user is responsible for safeguarding their access credentials (username and password) and undertakes not to transfer them to third parties. Any operation carried out through the account is deemed to be performed by the account holder. In the event of loss or unauthorised access, the user must promptly notify Kyron.
3.3 Account suspension and deletion
Kyron reserves the right to suspend or delete the account in the event of breach of these T&C, improper use of the Site or prolonged inactivity (over 12 months). The user may request deletion of their account at any time by writing to info@kyronedu.it.
Products and Availability
The Site offers hardware products and technological devices (computers, tablets, mobile devices, accessories and network equipment). Product descriptions, images and technical specifications are provided for guidance and may be updated without notice.
Product availability is shown on the Site in real time but cannot be guaranteed with absolute certainty due to the dynamic nature of stock. Should an ordered product be unavailable, Kyron will promptly inform the user, offering, at the user's choice: an equivalent alternative product, a back-order, or a full refund of any amount already paid.
Prices
Prices shown on the Site are expressed in Euro and are understood as:
- VAT included for private consumers;
- VAT excluded for economic operators and Public Administrations (the applicable VAT will be shown at checkout and in the tax document).
Kyron reserves the right to change prices at any time. The price applied to the order is the one shown on the Site at the time the user confirms the order. In the event of a manifestly anomalous error in the published price, Kyron reserves the right to cancel the order, notifying the user immediately with a full refund.
Public Administrations may be offered specific prices and conditions in accordance with Consip conventions, framework contracts or bilateral agreements signed.
Ordering Procedure and Conclusion of the Contract
The order is concluded according to the following procedure (art. 1326 of the Civil Code and art. 13 of Legislative Decree 70/2003):
- the user selects the products and adds them to the cart;
- the user logs in or registers and enters billing and shipping details;
- the user chooses the payment method and views the order summary (contractual proposal);
- the user confirms the order by clicking «Confirm and pay» or equivalent;
- Kyron sends an order-receipt confirmation e-mail (automatic receipt, non-binding);
- the contract is finalised when Kyron sends the order-acceptance and shipping-confirmation e-mail.
Kyron reserves the right not to accept orders in the event of incomplete or inaccurate data, non-payment, product unavailability or anomalies detected in the transaction.
Payment
The Site accepts the following payment methods:
- Credit or debit card (Visa, Mastercard and other circuits accepted by the online payment system);
- Advance bank transfer (the order is fulfilled after receipt of payment; the transfer details will be provided at checkout and in the order-confirmation e-mail).
Card payments are handled through a PCI-DSS-certified payment gateway. Kyron does not store users' payment-card data.
For Public Administrations, payment by payment order/mandate is accepted, in compliance with split-payment rules (art. 17-ter of Presidential Decree 633/1972) where applicable.
Shipping and Delivery
Kyron ships throughout Italy (including the islands) via express couriers. The shipping conditions are as follows:
8.1 Delivery times
The delivery times shown on the Site are estimated and not guaranteed. Save for force majeure or delays attributable to the courier, Kyron undertakes to deliver the products within the time indicated in the order confirmation. For Public Administrations, delivery times may be defined in the individual contract.
8.2 Shipping costs
Shipping costs are shown at checkout before order confirmation. Any thresholds for free shipping are shown on the Site and may vary.
8.3 Checking on delivery
The user must check the integrity of the package upon delivery. In the event of visible damage or anomalies, the user must record a written reservation on the transport document and contact Kyron within 24 hours of delivery at info@kyronedu.it.
8.4 Failed delivery
In the event of failed delivery for reasons attributable to the user (wrong address, recipient repeatedly absent), the storage costs and the cost of a second delivery attempt are borne by the user.
Right of Withdrawal (Consumers only)
This section applies exclusively to consumers within the meaning of art. 3(a) of Legislative Decree 206/2005. It does not apply to professionals, companies and Public Administrations.
The consumer has the right to withdraw from the purchase contract without giving any reason within 14 days from the date of physical receipt of the product (art. 52 of Legislative Decree 206/2005).
9.1 How to exercise withdrawal
Withdrawal may be exercised by sending written notice to Kyron S.R.L. before the deadline, by e-mail (info@kyronedu.it), PEC (kyron@arubapec.it) or registered post with return receipt (Via Cassia 515, 00189 Rome (RM)). The consumer may use the standard withdrawal form provided in Annex I, Part B of Legislative Decree 206/2005, available on request.
9.2 Returning the product
The product must be returned intact, in its original packaging, complete with all accessories, within 14 days of the withdrawal notice. Return costs are borne by the consumer, unless otherwise indicated by Kyron.
9.3 Refund
Kyron refunds the entire amount paid, including the original shipping costs (except for additional costs of delivery methods other than the standard one), within 14 days of receiving the returned product or proof of its shipment. The refund is made using the same payment method used for the purchase.
9.4 Exclusions from the right of withdrawal
The right of withdrawal does not apply, pursuant to art. 59 of Legislative Decree 206/2005, to products:
- made to measure or clearly personalised;
- sealed that are not suitable for return for hygiene or health-protection reasons and were opened after delivery;
- that have been installed, configured or activated by the user in a non-reversible manner.
Warranty and Conformity
10.1 Consumers
For consumers, the legal guarantee of conformity of 24 months from delivery applies, pursuant to artt. 128-135 of Legislative Decree 206/2005. In the event of a conformity defect, the consumer is entitled, at their choice, to repair or replacement of the product, or to a price reduction or termination of the contract.
10.2 Professionals and Public Administrations
For parties not qualifying as consumers, the warranty for defects under artt. 1490 et seq. of the Civil Code applies. Defects must be reported within 8 days of discovery, under penalty of forfeiture (art. 1495 of the Civil Code).
10.3 Manufacturer's conventional warranty
Products may be covered by the manufacturer's conventional warranty (e.g. Apple, HP, Lenovo). This warranty is in addition to the legal one for consumers, and its conditions are specified in the documentation accompanying the product.
Intellectual Property
All content on the Site (text, images, logos, graphics, software, site structure) is the exclusive property of Kyron S.R.L. or licensed to Kyron, and is protected by copyright law (Law 633/1941) and applicable EU legislation.
Any reproduction, distribution, modification or use of the Site content without Kyron's prior written authorisation is prohibited. Third-party manufacturers' trademarks (Apple, Microsoft, etc.) are the property of their respective owners.
Limitation of Liability
Kyron is not liable for any direct or indirect damages arising from:
- interruptions, malfunctions or inaccessibility of the Site for technical reasons or force majeure;
- improper use of the Site or of the purchased products by the user;
- content of third-party sites reachable through links on the Site;
- delivery delays attributable to the courier or to force majeure.
Kyron's liability towards consumers remains in any case limited to what is provided by mandatory consumer-protection law (Legislative Decree 206/2005). Towards professionals and Public Administrations, Kyron's liability is in any case limited to the value of the individual order.
Clauses Requiring Specific Approval
Pursuant to and for the purposes of artt. 1341 and 1342 of the Civil Code, the following clauses, being potentially onerous for the user, require specific and separate approval by the user at the time of registration or ordering. The user declares to have read and to specifically approve the following clauses:
- Art. 4 (product availability and Kyron's right to cancel the order in case of unavailability);
- Art. 5 (price changes and Kyron's right to cancel orders with an anomalous price);
- Art. 6 (finalisation of the contract subject to acceptance by Kyron);
- Art. 8.4 (storage costs and second delivery attempt borne by the user);
- Art. 12 (limitation of Kyron's liability towards professionals and Public Administrations);
- Art. 15 (competent court).
Processing of Personal Data
The processing of personal data of Site users and purchasers is governed by Kyron S.R.L.'s Privacy Policy, available at the page /privacy, drawn up pursuant to Regulation (EU) 2016/679 (GDPR) and Legislative Decree 196/2003.
Using the Site and placing an order imply having read the information notice on the processing of personal data.
Applicable Law and Competent Court
These T&C are governed by Italian law.
For consumers
In the event of disputes, the court of the consumer's place of residence or domicile has jurisdiction, pursuant to art. 33(2)(u) of Legislative Decree 206/2005. The consumer may also use the alternative dispute resolution (ODR) procedure through the European platform: https://ec.europa.eu/consumers/odr.
For professionals and Public Administrations
For any dispute arising from these T&C, the Court of Rome has exclusive jurisdiction, to the exclusion of any other court.
Final Provisions
Should one or more provisions of these T&C be null or ineffective, the remaining provisions retain their validity and effectiveness.
Kyron's failure to react to a breach of the T&C does not constitute a waiver of the right to enforce that breach at a later time.
